Read this before creating an account or making a purchase.
By using Pharming Factions, you agree to these terms. They include a binding arbitration clause and a waiver of class actions (Section 15) that affect how disputes are resolved.
1. Acceptance
These Terms & Conditions form a binding agreement between you and Pharming Factions, LLC ("Pharming Factions," "we"). By creating an account, browsing while signed in, posting, messaging, or transacting on the platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the platform.
2. Eligibility & age
Under 13: You may not create an account.
13 to 17: You may create a learning account with parental knowledge. You may read articles and listings, comment on community updates and articles, save favorites, follow contributors, and browse careers. You may not buy, sell, post listings, RSVP to in-person events, trade digital assets, or send or receive direct messages on the platform until you turn 18. We collect a parent or guardian email at signup so they know your account exists; we do not require ongoing parent action.
18 and over: Full platform access. If you are buying for or on behalf of a minor in your household, you must do so from your own 18+ account.
Parents and guardians are responsible for supervising the use of any 13-17 account associated with them. We are not a substitute for parental supervision.
3. Account responsibility
You are responsible for keeping your credentials secure and for all activity that occurs under your account. Notify us immediately at masalla.pharmingfactions@gmail.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.
4. Marketplace intermediary — we are a platform, not a seller
Pharming Factions provides a platform where independent users list, discover, and transact for goods and services. We are not the seller of any product listed on the platform. Sellers are solely responsible for:
- The accuracy of their listings (descriptions, claims, imagery)
- Any certifications referenced (organic, non-GMO, fair-trade, lab-tested, etc.)
- Product safety, packaging, labeling, and regulatory compliance
- Fulfillment, shipping, and customer service
- Tax collection and remittance applicable to their sales
Pharming Factions does not verify, endorse, or guarantee any listing. We do not inspect products. We facilitate connection and payment; we do not stand behind seller claims.
5. Herbs, supplements, and medicinal plants — important disclaimer
FDA disclosure
Statements about herbs, supplements, and medicinal plants made by sellers, contributors, or any user on this platform have not been evaluated by the United States Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease. Pharming Factions does not provide medical advice. Consult a qualified healthcare provider before using any product purchased through this marketplace, especially if you are pregnant, nursing, taking medication, or have an existing medical condition.
This disclaimer also appears inline on every product detail page in the herbs/supplements categories.
6. Agriculture outcomes — no guarantee
Growing outcomes are inherently variable. Pharming Factions makes no guarantee regarding:
- Plant survival, germination rates, or yield
- USDA zone accuracy for any specific microclimate
- Suitability of any plant, seed, or supplement for a particular use
- Outcomes affected by weather, pests, disease, soil conditions, or regulatory changes
Heirloom and heritage varieties may exhibit especially variable germination and growth. Force majeure events — weather, natural disasters, governmental action — release both parties from related performance obligations.
Noxious & invasive species
Pharming Factions does not verify whether any plant, seed, or tree listed, given, or traded on this platform is a noxious or invasive species regulated under federal, state, or local law. That determination — and compliance with it — is solely the responsibility of the member posting or accepting the listing. 7. Your content — what you post
You retain ownership of content you post (listings, reviews, farmer tips, articles, messages, imagery, "Your Content"). You grant Pharming Factions a worldwide, non-exclusive, royalty-free license to host, display, reproduce, modify (for technical purposes such as resizing imagery), and distribute Your Content for the purpose of operating the platform.
After account deletion: We anonymize Your Content within 30 days of account deletion. Aggregated or anonymized content may remain visible (for example, a farmer tip you wrote may continue to be displayed with attribution removed) so that threads and references on the platform do not break.
You warrant that Your Content does not infringe any third party's rights and that you have permission to post images of any identifiable people.
8. Prohibited content and conduct
You may not:
- List illegal substances or controlled drugs
- List any product whose sale requires a DEA, USDA, or state license you do not hold
- Misrepresent products (false organic claims, fake lab results, mislabeled species)
- Engage in hate speech, harassment, doxxing, or threats
- Scrape the platform, abuse its APIs, or interfere with its operation
- Solicit or facilitate transactions that bypass the platform's payment system in order to evade marketplace rules
- Use the platform to identify, contact, or target minors
We may remove content and suspend accounts for any violation.
9. Transactions and payment
Payments are processed by Stripe. By transacting, you also agree to Stripe's terms. Pharming Factions facilitates the transaction; the contract for the goods or services is between buyer and seller.
Disputes between buyers and sellers should be resolved directly. If escalation is needed, contact masalla.pharmingfactions@gmail.com with order details. We may mediate at our discretion but are not obligated to do so.
10. Affiliate disclosure
Pharming Factions may earn a commission on purchases made through certain links on this site, including links to products on this platform and on affiliated properties. This disclosure satisfies the United States Federal Trade Commission's requirement for clear and conspicuous affiliate-relationship disclosure.
11. In-person community events
Users sometimes organize in-person events using the platform. Pharming Factions does not host, attend, vet, certify, or insure any in-person event. Event organizers are solely responsible for safety, permits, insurance, supervision of attendees, and compliance with local law.
You attend in-person events at your own risk. RSVPs are restricted to users aged 18 and over. Adults are free to bring minors in their household to an event they have RSVP'd for; doing so is solely the adult's responsibility, and the adult assumes full responsibility for the minor's safety, conduct, and supervision at the event. Pharming Factions takes no responsibility for any minor at any in-person event, regardless of who brings them.
12. Digital assets (forward-looking)
Trading of digital assets — including cryptocurrencies and tokenized goods — may be enabled in a future version of the platform. When enabled, additional terms governing such transactions will be presented and acceptance will be required. Until that time, no provision of these Terms shall be construed as authorizing or facilitating any digital-asset trading on the platform. Any digital-asset features will follow the same age policy: 18 and over only.
13. Indemnification
You agree to indemnify and hold harmless Pharming Factions, LLC, its officers, employees, and affiliates from any claim, loss, or expense (including reasonable attorneys' fees) arising from:
- Your use of the platform
- Your violation of these Terms
- Your violation of any third party's rights
- Content you post or transactions you conduct
14. Limitation of liability
To the maximum extent permitted by law, Pharming Factions's total liability arising from or relating to the platform is capped at the greater of (a) one hundred US dollars (US$100) or (b) the total fees you have paid to Pharming Factions in the twelve months preceding the claim.
We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or loss of goodwill, even if advised of the possibility of such damages.
Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the maximum extent permitted.
15. Dispute resolution — binding arbitration & class waiver
Read this section carefully. It affects your legal rights.
Except for small-claims actions and requests for injunctive relief to protect intellectual property, any dispute, claim, or controversy arising out of or relating to these Terms or the platform shall be resolved by binding individual arbitration under the streamlined arbitration rules of JAMS, held in or near the County in New Mexico where Pharming Factions maintains its principal place of business, conducted in English.
Class action waiver: Disputes must be brought in your individual capacity. You waive the right to participate in any class action, collective action, or representative proceeding.
30-day opt-out: You may opt out of this arbitration clause by emailing masalla.pharmingfactions@gmail.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out does not affect any other provision.
16. Copyright complaints (DMCA)
If you believe content on the platform infringes your copyright, send a written notice to masalla.pharmingfactions@gmail.com with the subject line "DMCA Notice" containing:
- Your physical or electronic signature
- Identification of the copyrighted work
- The URL of the allegedly infringing content
- Your contact information
- A statement of good-faith belief that the use is unauthorized
- A statement, under penalty of perjury, that the above information is accurate and that you are authorized to act for the rights holder
We respond to valid DMCA notices by removing or disabling access to the content and notifying the user who posted it. Repeat infringers are subject to account termination.
17. Termination
You may delete your account at any time from your account settings or by emailing masalla.pharmingfactions@gmail.com. We may suspend or terminate any account that violates these Terms, harms the platform or its users, or as required by law. Sections that by their nature survive termination (intellectual property, indemnification, limitation of liability, dispute resolution, governing law) survive.
18. Governing law
These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
19. Changes to these Terms
We may update these Terms. Material changes will be communicated by email to the address on your account at least 30 days before the effective date. Continued use of the platform after the effective date constitutes acceptance. The current version is always available at this URL with the "Last updated" date at the top.
